Hosting and Reseller Account Terms and Policies - All Servers
We do not allow the following on any of our servers. Any account(s) found breaking our policies will be removed and canceled without notice.
• Spamming (sending unsolicited email or posting messages to irrelevant UsetNet newsgroups that do not explicitly allow advertising, with references to a site hosted on our servers)
• Sites, sites encouraging illegal activity or racism, sites providing instructions or performing illegal activities. Any site conducting illegal activities and / or copyright infringements.
• Violations and attempted violations of system & network security. Or any type of tampering with the system with the purpose to inflict harm.
• Peer to Peer / Portal and upload and download type sites related to hacking and wares.
Any account found breaking the above policies will be suspended or terminated immediately.
Reseller and Sell-WHM Hosting: Remember that if you re-sell hosting on our servers you are responsible for what your clients do. It is your responsibility to monitor your clients to ensure that you enforce our TOS. If your clients are found repeatedly breaking our TOS that result in illegal activities, or server downtime, that this will put your account in jeopardy.
Server Types / Descriptions
Web Server - File hosting that you can view in a browser eg: PHP, SQL, HTML, .JPG, .GIF, .PNG, .XML mostly .SWF and .PDF are fine. If you can't view it in a browser, or it requires special software to view, it's a download or multi-media file.
Download Server - File hosting that you download from the server, eg: .ZIP, .RAR, .GZIP, .MP3, .AVI, .WAV, .DOC, .PSD, .AI, .EPS, .TGA, .TIF .
Media Server - Multi-media hosting eg: streaming video, streaming audio, radio, shout cast, pod cast, can include chat and shout box. We currenlty do not have a multi-meida server so we can not offer this type of hosting.
Gaming / Clan Server - Gaming servers / hosting usually use intensive server resources and require gaming servers or VPS. We currenlty do not have gaming servers so we can not offer this type of hosting.
TOS Terms of Service For Web Server Hosting
The following TOS is for Web Server Hosting:The Internet is a powerful information and entertainment tool, we would expect our customers to use the Internet with respect, courtesy, and responsibility, giving due regard to the rights of other Internet users.
Our acceptable use policy is actively and strictly enforced. Offending content or users are removed from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken.
Common sense is the best guide as to what is considered acceptable use, however the following are unacceptable uses.
Illegality: In any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, or trafficking in obscene material.
Undesirable Content: Certain types of content are not permitted on our network. We do not host pornographic content of any description. We reserve the right to determine what constitutes pornographic content and what does not (see adult sites below). Content relating to Hacking, Cracking, Warez and IRC is not allowed. HYIP (High Yield Investment Programs), Ponzi schemes or pyramid schemes are not permitted on our network. Our web servers may not be used to provide proxy servers (or paid to click). Software downloads may only be hosted if you are the writer and copyright owner of the software, all other software including freeware, shareware and trial software is forbidden. The sale of resellable eBooks is ok. Large download files must be hosted on our download server.
Bulk Email: The use of our network to send bulk email whether opt-in or otherwise, and the use of bulk email to promote a site on our network is strictly forbidden. As a guideline, we consider sending over 200 emails a day as bulk email.
Misuse Of Resources: Including but not limited to employing applications which consume excessive CPU time, memory or storage space. Chat/IRC/Shout Box, web proxy, paid to click and mailing list scripts are not allowed on our network under any circumstances. Streaming media, audio, video and shout cast can be a drain on web server resources and as such is not allowed. Image hosting where our servers are used to store and serve images. Busy message forums and game / gamers sites are often found to use excessive system resources. The use of web cam applications which maintain a constant FTP connection uploading an image at regular intervals is forbidden. No site may use a high percentage of CPU or Memory (10%+) usage.
Password Protected Directories: Using password protected directories to conduct illegal activities is strictly prohibited. Sites that use password protected directories where their use is not clear are subject to suspension while we investigate the legality of the hidden content.
Download Files: Collections of download files are not permited on shared web servers because they slow the server down. A reasonable amount of download files can be permitted if you keep the file size under 2000 k . Download files must be hosted on our download server. All content stored on a reseller account must be directly used on the Internet by the website associated with that account. These accounts may not be used as a download distribution point for your software or media. They are to be used for standard web practices only.
Pornographic Media: Pornographic media is not permitted. Adult commercial sites are however, permitted including: lingerie sales, adult toy e-commerce sites, Viagra sales, adult health and sexuality, and similar if all models are over 18 are permitted.
Excessive Server Resources: This means that all content stored on an unlimited account must be used for "acceptable" website use. “Unacceptable” usage is anything that a shared server would not be able to provide under standard circumstances and uses a high percentage of CPU or Memory (10%+) usage.
If you are unsure about content you intend to place on our network, please check with us before you do. We reserve the right to determine what constitutes acceptable use.
Unlimited / Unmetered Hosting Packages
When we say unlimited domains, unlimited disk space and bandwidth, of course there are terms & conditions that you must adhere to. This means unlimited webpages, domains and web graphics, not downloads or streaming media. Our servers are shared web hosting servers and memory and CPU usage is not unlimited. CPU intensive files are not permitted on our servers and accounts may not to be used to host a collection of mp3s, audios, videos, anime, .rar files, Warez, gamers sites, shout cast and similar, or to backup your computer or another source. They may not be used for general storage of any type. They may not be used as download mirrors or download/upload portals. While the sale of eBooks and other legal small download files are permitted within reason (see download files above) with the unlimited package, hosting and storage of mass quantities where our servers are used as a distribution point is not permitted. Download files must be hosted on our download server.
Free hosting is not permitted with unlimited packages, if you intend to offer free domain-based hosting, please choose one of our metered packages. With unlimited packages free hosting is only permitted within reason when the user has their own domain. Sub-domain hosting is only permitted within reason, and your clients are expected to have their own domain. Our servers are intended to host websites offering products and a service, if you are giving away free hosting space that is compromising our business customers, we reserve the right to request that you switch to a metered package.
Sell-WHM Master Reseller Hosting Packages
All of the above also applies with this package. As a Master Reseller you are ultimately responsible for the conduct of your clients, you must monitor your client activities, and enforce our TOS with your Sub-WHM accounts. If you have a problem sub-account that is found breaking our TOS we will suspend / terminate the problem account to protect the server first, before your master account is suspended. If server administrators or the data center suspends a sub-account, and you un-suspend your sub-account without permission from us first, your master account may be terminated. Master accounts with repeat problem sub-accounts, where it is clear you are not monitoring your client's activities, your Master Account may be terminated or moved to another server where the poor conduct of your clients will not affect other Master Resellers and their clients. Our sell-WHM packages are only one level deep. This means that only you are permitted to sell hosting packages with WHM. You are not allowed to sell packages that allow others to sell reseller packages with WHM. Any reseller found selling Sell-WHM packages two levels deep will be terminated.
Account activation
We activate new accounts within 24 hours after we receive your payment. In most cases, we will activate your account within 2 or 3 hours but sometimes we may need more time to verify your payment and make sure it is not fraudulent. We do not accept payments from unverified PayPal accounts!
Payments
You agree to pay for the services on time. Unpaid invoices will result in temporal suspension of your account. Invoices are generated 7 days before the renewal date and your account gets suspended 7 days after the renewal date if the invoice is not paid until that time. Your account will be terminated if it was not paid within 3 days after it was suspended. If you want us to restore it after it was terminated because of non-payment, and we have a backup of the terminated account you will have to pay $25 one-time fee plus all the renewal fees. We do not guarantee we will have a backup of your account after it was terminated!
Contact information
Customer agrees to provide correct payment and contact information. The customer is responsible to have a valid e-mail address on file at all times. We will use that e-mail address to contact you about abuse problems, unpaid invoices, suspended accounts and any other issues.
Cancellation
Cancellation requests must be sent to our billing department. They may take up to 48 hours to be processed.
Canceling your PayPal or 2CheckOut subscription may result in immediate cancellation of your hosting account regardless of any remaining time left that you have pre-paid for. Be sure that you have copies of your web files before you cancel your hosting.
Responsibility
Resellers are responsible for the actions of their clients. If your client’s actions violate our terms of service we will suspend his account and we will send a notice about the issue to your contact e-mail address on file.
We will not be held responsible for any harm or damage caused by the use of our services. Customer agrees to use our services on his own risk.
15 day money back guarantee
If you cancel your account within 15 days from your signup date, we will issue a full refund except the money paid for domain names, script installs, SSL certificates. There are no refunds for dedicated and vps servers. The money back guarantee is valid for your first package only and can't be used for any other packages. A client can use this only once.
Please note that scheduled downtime is not counted as ‘real downtime’ and you will not get a refund for it. In order to get a refund, you will need to open a ticket with our billing department and claim the downtime by including logs and other details you feel relevant. The credit will be applied to your account within 7 days after your claim is approved.
Compliance with law
Our services can be only used for lawful purposes.
8. Prohibited content and prohibited actions
Customers cannot host the following content on our servers:
- Anything related to IRC
- Anything related to torrents
- Warez, hacking tools, exploits
- Porn web sites
- Anything related to proxies
You may not offer any free services like free e-mail, free hosting, free image hosting and similar free services.
You may not use the space we provide as a backup for accounts hosted elsewhere. The space you get can be strictly used only for your web site needs.
Customers may not start background processes on the server or anything which needs to bind to ports on the server.
Customers may not send SPAM messages from our servers. Spammers will be suspended immediately and never unsuspended.
Backup and restore
We do daily backups of your accounts. We will restore such a backup on request for free but we do not take any responsibility if the restore causes you problems. You agree to use our backups on your own risk and you are responsible for having a backup of your account at any time.
Although remote back-ups will be performed (some servers have local backups), Good Deal Hosting will not be held responsible for any loss of data. It is up to the hosting account to ensure you maintain a local copy of your web data for your own back-up purposes.
Bandwidth
If your account uses more than the allocated bandwidth to it, it will not be suspended but you will need to pay for the extra bandwidth at the end of the month. Unpaid used bandwidth will result in suspension of your account.
Transfers
We do free transfers of accounts you want moved to our servers from providers which use cPanel. We do not guarantee the quality of such transfers and you must verify if your account was moved correctly before you change the nameservers. If something is wrong with the account after the move and it wasn’t moved correctly it is your responsibility to fix it. In 99% of the transfers there are no problems but we do not guarantee that. We do transfers just because of courtesy to our clients.
Communication with our staff
Customers may communicate with our staff in polite manner. If you are rude with us, we will give you 72 hours to find another hosting provider. After 72 hours pass, we will permanently suspend your account and you will receive a refund for the unused portion of the service.
Personal information
We will not give your personal information such as name, address, e-mail address to third parties except if the law requires it and we have an official and lawful request for that. Any information submitted by the buyer will be used solely for the purpose of completing the transaction, delivering the product and addressing any customer service issues.
Limits
Customers may not send more than 100 e-mail messages per hour. Any account on the server cannot use more than 2% CPU or memory resources. If you use too many system resources, you will be notified to take the necessary actions. If the usage is too high to keep the server unstable, we will suspend the overloading account so that it doesn't affect the other clients on the server.
Changes to the terms
We may change the terms of service at any time without notification. The customer needs to check this document regularly for changes.
